Terms of Service and End User License Agreement (EULA)
You may use this URL as your custom EULA in App Store Connect (instead of Apple’s standard EULA) where permitted. Have this agreement reviewed by counsel for your markets, paid features, and mandatory consumer rules.
1. Agreement
These Terms of Service (“Terms”) form a binding agreement between Kisy Tech Ltd. Şti. (“Kisy App”, “we”, “us”) and you (“you”) regarding your use of the Kisy mobile application and related services (the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Kisy offers social discovery features, including profiles, discovery, matching, and messaging. The Service is provided on an “as is” and “as available” basis. We may modify, suspend, or discontinue features with or without notice, subject to applicable law and any commitments we make to paying subscribers (if applicable).
3. Eligibility
You must be at least 18 years old to use Kisy. By using the Service, you represent that you meet this requirement. We may terminate accounts that we believe are used by underage individuals or that misrepresent age. Dating and matchmaking apps must comply with store age rating and content policies; your Play Console and App Store settings must align with these Terms.
4. Account security
You are responsible for safeguarding your login credentials and for activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
5. Acceptable use
You agree not to:
- Violate any law or infringe others’ rights.
- Harass, threaten, abuse, stalk, or harm other users.
- Impersonate any person or entity, or create fake or misleading profiles.
- Spam, solicit money or investments fraudulently, or distribute malware.
- Post content that violates our Community Guidelines or applicable store policies (including sexual content rules where applicable).
- Reverse engineer, scrape, or use automated means to access the Service except as allowed by law.
- Interfere with or disrupt the Service or other users’ experience.
6. User content and licence
You retain ownership of content you submit. You grant Kisy Tech Ltd. Şti. (Kisy App) a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, and distribute your content solely to operate, improve, promote, and protect the Service and to comply with law. After you delete content or your account, we will remove or anonymise it within a reasonable time, subject to legal and safety exceptions.
7. Moderation and termination
We may warn, remove content, suspend, or permanently terminate accounts that violate these Terms or our Community Guidelines. You may delete your account at any time using the in-app flow (for example Settings → Account → Delete account).
8. Intellectual property
The Service, including the Kisy name, logos, design, and software, is owned by Kisy Tech Ltd. Şti. or its licensors. You may not copy, modify, or distribute except as expressly allowed.
9. Disclaimers and limitation of liability
To the fullest extent permitted by law, Kisy Tech Ltd. Şti. (Kisy App) is not liable for interactions between users, including offline meetings; use good judgment and follow safety guidance. The Service is provided without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation. To the extent permitted by law, our total liability for any claim arising from the Service is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) zero (0) if you have not made any payment to us, except where liability cannot be limited by law (for example death or personal injury caused by negligence).
10. Paid features and subscriptions
If you offer paid subscriptions or in-app purchases, describe pricing, billing cycles, renewal, cancellation, refunds, and how users manage purchases in accordance with Apple and Google rules. If no paid features exist: Currently, Kisy does not offer paid subscriptions or in-app purchases; this section will be updated if that changes.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye, excluding conflict-of-law rules. Subject to mandatory consumer protections that cannot be waived in your country of residence, the courts of Istanbul, Türkiye shall have exclusive jurisdiction over disputes arising from or relating to these Terms.
